Terms of Services

Though it seems to be a long page to read, we do encourage you to read these Terms of Service to have a better understanding on how Atmos’ relationship with you as you’re using our services. It is indeed important because you’re agreeing to these terms as you’re using our services.

Beside these terms, we also publish a Privacy Policy to help you understand more how Atmos cares about your confidentiality.

Your Relationship with Atmos

These terms help determine your relationship with Atmos. Generally speaking, you have our permission to use our services, if you agree to follow these terms. The words stated here; Atmos, we, us, and our, represent PT. ATMOS INFINA MULTICON and its affiliates.

What You can Expect from Us

Provide a Wide Range of Custom and Useful Services

We offer services related to websites and business systems that are subject to these terms. Our services are designed to be adjusted easily according to your needs, making it easier for you to organize your work efficiently. For example, editing website content can be simply done using our customized Content Management System (CMS) with Skybase.

Improve Skybase Services

We’re constantly applying new technologies and developing new features to improve our services. For example, we work with Google Cloud Platform with the purpose to have a low network latency as you’re using our services, as well as to ensure the confidentiality of your information. In regards to improving our services, we may also add or remove certain features and functionalities, or provide new services or discontinue old ones.

In case there are any material changes that would likely have an adverse impact on the use of our services, or if any services that will be stopped, we will give you a reasonable notice in advance and an opportunity to have your data migrated from our services, which will be assisted by our Support Team, except in urgent situations, such as improving the security and operability of our services, preventing abuse or complying with legal requirements.

What We Expect from You

Follow these Terms

We will continue to give you permission to use our services as long as you keep your responsibilities in these terms. Even though you are permitted to use our services, we own all intellectual property rights we have in the services.

Respect Others

Our services may allow you to interact with others within your own organization or even externally. We aim for a respectful environment for everyone, thus, you are obliged to follow these basic rules of conduct:

  1. Comply with these terms and applicable laws;

  2. Respect the right of others, including not to engage in any activity that is offensive, abusive or equivalent;

  3. Do not misuse any data or services that we and/or others provide;

  4. Do not try to interfere or harm or disrupt our services.

Permission to Use Your Content

By using our services, you are giving any information or content needed to us. Depending on your needs, some of our services may also be designed to let you upload, submit, store, send, receive or share your content, information, and/or any files. In regards, please make sure that you have the rights to do so.

You have full ownership of your own content, meaning that you own any intellectual property rights that you have in your content. For example, you keep the intellectual property rights in any creative content you make, such as the profile or story that you write on your website, or photos or designs that you upload in the system or website. You might be able to share others’ content if you have their permission.

Atmos has the right to use your content and/or information to develop our services for you, for example to make a custom business system in Skybase or to adjust your unique website.

Permissible use of Atmos Website and Content

The content provided in Atmos website is for your non-commercial use, thus your use must not be intended for any commercial advantage or monetary compensation. You may not copy, modify, distribute, transmit, display, perform, publish, create, sell or license Atmos website or any materials for user content. Other than this, you may play, view or listen to the content provided with the condition that these content are only for informational and non-commercial purposes and not be modified or altered in any way, including any copyright notices.

You are not allowed to use Atmos website in any manner that could damage, disable, overburden or impair any Atmos server. You may also not attempt to gain unauthorized access to any Atmos website, other accounts, computer systems or networks connected to any Atmos server, through hacking, password mining or any other means.

Using Atmos Services on Behalf of an Organization

By using our services, you are giving any information or content needed to us. Depending on your needs, some of our services may also be designed to let you upload, submit, store, send, receive or share your content, information, and/or any files. In regards, please make sure that you have the rights to do so.

Content in Atmos Services

Your Content

Our services may allow you to share your content publicly, for example the content you have on your website. You may check the Permission to Use Your Content section for more about your rights in your content, and how your content is used in our services.

Other's Content

There might be content that belongs to other people or organizations, and you might also have access to this content as you’re using our services. You may not use this content without any permission from that related person or organization, or else must be allowed by law.

Software in Atmos Services

Our services may include integrations with other software or web services made available by third parties, which you can access as you’re using our services. Please note that these other softwares or web services are subject to terms and conditions with those third parties.

You may not copy, modify, distribute, transmit, display, license, sell or lease any part of our services or software. Also, you may not reverse engineer or attempt to extract any of our source code unless you have our written permission or applicable law lets you do so.

If the service you are using includes these integrations, the related software sometimes updates automatically on your device once a new version or feature is available. Though some services allow you to adjust your automatic update settings.

In Case of Problems or Disagreements

As a customer, you have the right to use a certain quality of service and to fix problems in several ways if things go wrong, which are not limited or taken away by these terms.

Warranty

We develop and provide our services using reasonable skill and care. You may tell us if you feel that we don’t meet the quality level described in this warranty and we’ll try our best to work with you to try resolving the issue.

Disclaimer

The only commitments we make about our services are (1) described in the Warranty section or (2) provided under applicable laws. We don’t make any other commitments about our services.

We don’t provide implied warranties, such as the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, unless required by law.

Liabilities

These terms only limit our responsibilities subject to applicable law. Specifically, these terms don’t limit Atmos’ liability for damages resulting from death or bodily injury arising from gross negligence or willful misconduct.

Other than the rights and responsibilities described in this section, Atmos won’t be responsible for any other losses, unless they are caused by our breach of these terms.

Atmos won’t be liable, also to these following responsibilities:

  1. Loss of profits, revenues, business opportunities, goodwill, or anticipated savings;

  2. Any special, incidental, consequential or indirect damages;

  3. Work stoppage or for exemplary punitive damages.

Regarding liability cap, Atmos’ total liability arising out of or relating to these terms in any 12 month period will not exceed the annual subscription fees paid for the relevant services in the 12 months before the breach.

Taking Action in Case of Problems

Before taking action as mentioned and described below, we will provide you notice in advance, if possible, to describe the reason for our action and give you the opportunity to fix the problems. However, we may proceed without doing so in cases that doing so may lead to these, as mentioned below:

  1. Cause harm or liability to a user, third party, or Atmos;

  2. Violate the law or legal enforcement authority’s order;

  3. Compromise an investigation;

  4. Compromise the operation, integrity or security of our services.

Removing Your Content

We reserve the right to take down some or all the content that we reasonably believe to have breached these terms, violated applicable law or be able to harm or disrupt other users, third parties or Atmos. Several examples include content related to child pornography, content that facilitates human trafficking or harassment, and content that infringes someone else’s intellectual property rights.

Suspending or Terminating Your Access to Atmos Services

We reserve the right to suspend or terminate your access to any of our services if any of the following happen:

  1. You materially or repeatedly breach these terms;

  2. It is required in order to comply with any legal requirements or a court order;

  3. We reasonably believe that your conduct causes harm or liability to other users, third party, or Atmos — for example, by hacking, phishing, harassing, spamming, misleading others, or trying to take content that doesn’t belong to you.

About these Terms

We reserve the right to take down some or all the content that we reasonably believe to have breached these terms, violated applicable law or be able to harm or disrupt other users, third parties or Atmos. Several examples include content related to child pornography, content that facilitates human trafficking or harassment, and content that infringes someone else’s intellectual property rights.

These terms are made to describe the relationship between you and Atmos, easily. And to do so, we believe that using some examples from our services might help. Furthermore, they do not create any legal rights for other people or organizations, even if others benefit from that relationship under these terms.

We may update these terms (1) to reflect any changes in and/or improve our services — for example when we develop and add new features, technologies, pricing, or benefits, as well as probably removing old ones, (2) for legal, regulatory and security reasons, or (3) to prevent any harm or abuse that might occur.

We will provide you with a reasonable notice in advance in case we’ll have any material change regarding these terms. Following this, we will also give you the opportunity to review any changes, except regarding any of the following:

  1. When we launch a new service or feature;

  2. In urgent situations, such as to comply with required law or to prevent any ongoing abuse.

In case you don’t agree to the new terms, you should remove your content and stop using our services. You can also ask our support team to help you end your relationship with Atmos.
